I want Lisa Subeck to help me.
I want to understand what she means when she says, “our system is fundamentally flawed” regarding criminal justice and specifically cash bail.
In an interview on the WKOW 27 News program Capital City Sunday, Subeck said,
“I do acknowledge that our system is fundamentally flawed and a cash bail system does not treat all people equally, that those who cannot afford a higher cash bail have a different level of justice than those who can and that’s a problem and I will continue working to reform our system to make it fairer and more equitable at the same time as I work to make or insure our communities are safe.”

The reference to cash bail begins at minute mark 7:05.
What I want to understand is how a “fundamentally flawed” system can be reformed by applying the exact principle Subeck says created the problem.
In other words, if I commit a crime, I should not be penalized beyond my ability to afford the penalty.
That would not be fair.
Too bad I didn’t think of that before I committed the crime. Too bad the victim didn’t reveal how much they could afford to lose.
That would not be equitable.
Lisa Subeck is flirting with the idea that people who have less should be entitled to personalized treatment by the law and people who have more are at fault in the prosecution of crimes committed against them.
Lisa Subeck says she is working to make or insure our communities are safe.
